Greatest nigerian youths...great...I am very happy dat we have finally resolved to go on a peaceful protest...I am currently in lagos but will be in abuja by tomorrow so I can partake in d protest scheduled to hold in front of total filling station,however I will like to knw the time of commencement cos I knw I will b in a meeting btw 8am and 10am on monday after which I will walk down to meet my fellow comrades... (Reuters) - Nigeria's long-awaited oil law, when it finally comes, looks likely to be a botched job that gives favourable tax terms to foreign oil firms while doing little to satisfy calls for transparency and reform of a corrupt and wasteful sector.
A new draft of the long-awaited Petroleum Industry Bill (PIB) is close to being finalised, potentially ending years of uncertainty that has blocked billions of dollars of investment.
Licensing rounds, contract renewals and investment have been put on hold for five years pending the new bill to regulate Africa's top oil and gas industry. Passing the bill will allow such work to resume.
But provisions that would have forced the government to publish how much oil it pumps and all the payments it receives from oil firms - in an industry where secrecy is blamed for corruption - have been stripped from the bill.
"I expect the petroleum industry to be happy. I expect many Nigerians to be upset," said Pedro Van Meurs, an oil and gas expert who has consulted with the government on the PIB.
"Transparency provisions related to corporate income tax, hydrocarbon tax and production sharing were deleted. This should be a source of concern."
The PIB is meant to change everything from fiscal terms to overhauling the Nigerian National Petroleum Corporation (NNPC). Its comprehensive nature caused years of disputes between lawmakers, ministers and oil majors.
The latest copy proposes some changes that will improve transparency: keeping royalty payments secret will not be allowed, for instance. Oil company profit taxes proposed in the bill are also in the public domain for the first time.
But it does not require disclosure of oil sales, of other taxes like income and hydrocarbon tax, nor of payments to the government, including signature bonuses. Openness on such subjects is vital to clean up the energy sector, say campaigners.
President Goodluck Jonathan commissioned a task force in January to fast-track a new copy of the PIB, which makes the passage of this condensed version more likely, even if the national assembly debate on it takes a while.
Jonathan said on Tuesday the new PIB would be sent to the national assembly next month.
"Passage of any piece of legislation brings a level of certainty to the industry that has been absent for years," said Gordon Bottomley, Nigeria analyst at Ergo, a New York-based advisory firm that has been closely tracking the PIB.
"(But) the re-organisation of ... Nigeria's oil and gas industry is going to be far from painless. And this bill, in terms of transparency, appears less than desirable."
NEW POWERS FOR MINISTER
The bill also gives the oil minister new supervisory powers over all industry institutions, including a new regulator to police downstream and upstream, raising concerns about checks and balances. Lawmakers had rejected drafts that did this in the past.
It says anyone who "interferes" with the minister will be fined or imprisoned. And it allows the oil minister and the directors of state institutions to receive gifts, which will not please civil society groups calling for an end to graft.
Foreign oil companies like Shell, Chevron and Exxon will be relieved that tax changes are more favourable compared with previous versions. This could be a sticking point with lawmakers seeking a better deal for Nigeria.
Analysts say that the taxes foreign firms pay on profits onshore, which will be published under the PIB, will amount to a big cut from the taxes that are now levied in secret.
Furthermore, the cut will apply both to existing fields and to new fields, unlike in earlier versions of the law which cut taxes only on new fields, the analysts say. Van Meurs says the government could lose 20-50 percent of its tax revenue per barrel on existing assets.
NATIONAL OIL COMPANY
Detail is thin on plans to partly sell off the mismanaged NNPC, seen by experts as the biggest barrier to progress.
Nigeria exports some 2 million barrels per day (bpd) but could double that with a better-managed state oil firm able to pay for its share of joint ventures, foreign oil majors say.
NNPC was last month described by parliament as "answerable to no one" in a probe into a $6.8 billion fuel subsidy fraud. It is accused by oil traders of owing billions in unpaid bills.
The NNPC rejects allegations of corruption or insolvency.
The PIB proposes a new National Oil Company (NOC), which will within three years be partly listed, in theory leading to much-needed accountability.
But the PIB isn't clear on what assets the NOC gets. The old NNPC would still exist and keep joint ventures and production sharing contracts with oil majors, which cover the majority of Nigeria's known oil and gas reserves, for an indefinite period.
"For arguably the most important element of the bill, it is worrying the section on NNPC is both brief and vague," an executive at an oil major operating in Nigeria said.
There is also no domestic gas pricing in the bill, which is key to unlocking the world's seventh largest gas reserves.
Left in doubt are onshore licenses Oil Minister Diezani Alison-Madueke is in the process of renewing. She signed a 20-year one with Exxon worth trillions of dollars in February and has promised to do the same with Shell and Chevron by June.
It has not been made clear whether they will include clauses exempting them from the PIB, in which case a huge portion of the oil business would not be governed by the new bill.
"It's meant to be single framework for everything in oil and gas. If you are going to have it but then do a special deal for, say, Exxon ... That would be a huge departure from what the bill was meant to be," said Antony Goldman, head of PM Consulting.

Firstly, I want to appreciate the views of @naijapatriot12 to this debacle. your view of "mass inquiry" is bedrock of this peaceful protest. However, I do not agree that questions should not be asked about the almost 2years delay in the process, even after the passage of 2012 budget into law and the probe report now out. This is givin the precedent of the 2008 botched recruitment and the looming retirement of NNPC management. Though we should NOT put words into their mouth by mentioning the PIB, they rather explain themselves and give a definite date for release of letters.
I therefore wish to seek your permission to edit your earlier write-up, to be incorporated as aPress Statement by NNPC/DPR hopefuls to be delivered and published in as many nationaldailiesas possible and to be aired on both radio and TV on Monday 4th June, 2012 ahead of our planned peaceful protest at all NNPC offices in Abuja, Lagos andPort-Harcourt.
Our fundamental human rights to peaceful protest is in line with sections 39-40 of the Constitution of the Federal Republic of Nigeria 1999, as well as Articles 9-11 of the African Charter on Human and Peoples' right. It baffles me how @ABCD123 resorts to reckless insults and abusive statement in order to "dissuade" those trying to express their civic rights. I believe everyone is entitled to his/her own opinion, but no one is entitled to insult the other.
In view of our need to seek police consent and security, I was at office of the Commissioner of Police, Lagos state Police command Ikeja, where I filled an application for permit for a peaceful protest dated 31st May 2012 and officially acknowledged. In my application, I also stated that the same protest shall be taking place in Abuja, Port-Harcourt as in Lagos, so we can all be covered nationwide. In addition, I have notified the Police Public Relations Office as well as the Ikoyi/Onikan Police station appropriately.
Also the press statement has been circulated to media houses to be published on Monday, 4th June 2012. The following media houses have so far been copied: ThisDay, Leadership, The Sun, The Guardian and Vanguard newspapers, as well as CoolFM radio station thru radio presenter Super-C and NTA thru TV presenter, Cyril Stober.

A PRESS STATEMENT BY CONCERNED NIGERIAN GRADUATES ON THE CONTINUED DELAY OF NNPC/DPR MANAGEMENT TO RELEASE APPOINTMENT LETTERS TO SUCCESSFUL CANDIDATES AFTER MONTHS OF INTERVIEW AND DEHUMANISATION OF NIGERIAN GRADUATES
Sometime around August in 2011, the Group Managing Director (GMD) of the Nigerian National Petroleum Corporation announced to the consternation of Nigerians that 80% of the over 40,000 Nigerians that sat for the recruitment test of the corporation failed. This result was even more disastrous considering the fact that those who failed where either first class or second class upper degree graduates. Nine months later, fellow Nigerians, the successful candidates who were being interviewed at the time that very inauspicious declaration was made do not know their fate. To fully appreciate the import of the following discourse, the reader might need to be informed that this recruitment process began in November 2010, when the NNPC announced recruitment positions in the corporation and its subsidiaries.
On the 25th day of March 2011, over 40,000 young, bright and promising Nigerian youths sat for the NNPC's recruitment test in various locations across the country having met the stipulated recruitment criteria. Many of these young chaps, including yours sincerely, had to pass through a lot of rigors in order to write this test. Many of the candidates had to embark on harrowing journeys on the death traps we call inter-state roads. Others traveled from various parts of the world- Europe, the Americas, Asia, and Australia on personally funded flights.
On getting to the test venues, instead of a little respite in the form of already sorted out logistics, they were welcome by what could best be described as cut-and-nail arrangements. In their hordes, these hopeful Nigerian youths bore the infernal heat of the sun, as they waited for the officials of the NNPC and Phillips Consulting, to make face-saving reparations to their blighted first impressions. Such was the hope of the "hopefuls", that even though a test that was earlier scheduled for 11am was delayed till about 5pm (and even 6pm in some venues), their resolve was not in a bit deterred. They strained their eyes to make use of the little light the dark halls could afford them. Nothing could better define the enthusiasm of these young ones than the arrival of a newly wedded bride still dressed resplendently in her wedding gown making her way through the crowd to "secure her future".
Despite these inconveniences, 20% of the candidates - as asserted by no less a person than the GMD himself, braved the odds, passed the test and were invited for interviews. The last batch of successful candidates were interviewed at the NNPC towers in mid-august 2011, in a time when the security situation of Nigeria could best be described as tenuous, owing to the endless bombings that were becoming rife. Once again, optimistic Nigerians made the trip to the NNPC towers across lands, air and oceans at personal expense.
As is the tradition, account numbers of the interviewees were collected to facilitate payment of their transportation allowances. Forward to nine months later and the “hopefuls” are still hoping. There is no gain saying that the Phillips Consulting officials and the NNPC senior staff members involved in the recruitment exercise have been paid their allowances, while not even the transportation allowances of the interviewees have been paid.
Nine months gone and counting, hopefuls have been waiting with bated breath for the conclusion of this recruitment process. Hopefuls are increasingly wary, because the conspiracy of silence on this process forebodes ominous signals as was the case with the 2008 recruitment, which was ingloriously swept under the carpet. The expectations have reached feverish pitch as evidenced by discussions on various fora created for this purpose.
The question that keeps begging for an answer is: What offense did the Nigerian youth commit? Even though the issue of the fuel subsidy probe has been espoused as a possible excuse for the delays by some, the corporation and its parent ministry have gone ahead to present and defend budgets for the year which made provisions for increased manpower. If the NNPC management doesn’t have ulterior motives, what then is stopping the release of appointment letters to successful interviewees? If the GMD was so quick to denigrate those who in his allusions are pretenders to the degrees they possess, is it not only fair to reward those who proved their mettle.
The NNPC and her sister organisation, the Department of the Petroleum Resources (DPR) have decided to play the ostrich concerning the recruitment of a few deserving Nigerian youths, whereas in this nation, billions of Naira have gone into sustaining the avarice of a few undeserving persons including top management staff of these two organizations. It is even more disheartening that in the recently held ministerial platform, the Minister under whose watch this hogwash was perpetuated shied away from it. It needs some reiteration that it is the career of hardworking, deserving young Nigerians that is being toyed with by a privileged few. The President, Minister and top management staff of these organizations should remember that “those whose nuts were cracked by benevolent spirits are morally obliged to others”.
The successful conclusion of this process or otherwise will call to question the genuineness of Mr. President’s transformation agenda, which most of the hopefuls bought into, and gave him their votes for. It is unjust that in this nation, a cabal of few persons who brought this nation down on her knees still run amok, whereas the employment of a few thousand youths (whose collective annual wages wouldpale in the face of a single loot) has become a matter of contention. So far, the hopefuls have remained calm. We are gentlemen and ladies in the very sense of it; we are responsible professionals/would be professionals, but there is a point to which we can suffer the evil in the land.
We are therefore taking our destinies in our hands by waging a peaceful protest as law-abiding and responsible citizens to draw the attention of government to the evil menace. It is our hope that the government, the Minister and management of NNPC lends a listening ear to our plea and respond by a speedy conclusion of this long-running recruitment process and invite successful candidates for training.
We appreciate the involvement of media and civil society to our cause as an injustice against the Nigerian youth is one against the nation's future.

I thought a gestapo would be on the rampage, i thought we will take them through a macabre dance of molten lead. since the house is unanimous in its resolve on peaceful protest, the terror intended to be unleashed by selected gestapos and espionage is hereby suspended. i hereby postulate a violent free protest in tandem with the gentle manliness of the formidable crop of egg heads present in this forum, since an aphorism has it that the collective intelligence of the society is presumed sounder than individual reasoning. In lieu of the suspended intention of violence, i suggest the display of vocal efficiency, coherence in locution and an unblemished command of the lingua franca through a clarion call and a challenge to prof salvage to make himself available at the Abuja protest, so that they can truly be dazed by the profundity of our erudition. All hopefuls should brace up to this historical challenge and assist to sweep out the cobwebs of deceit from the bureaucratic structure that is operational in Nigeria, by coming out enmasse to kick out the monolithic stance of disregard for the Nigerian graduate. It is not about the letters, it is about making them realise that we have a right to be heard, and Nigeria is our father land and not for the selected few or bandwagon of oligarchy. i wll personally be at tha Abuja protest, see the brave minds at the Abuja protest. Prof salvage please be there, even if it means embarking on an impromptu flight from your base in Newyork, your presence will be a plus factor.
